Cosa rende valida una comunicazione

Un avviso di presa in carico sotto 17 U.S.C. § 512(c)(3) obbliga un host ad agire solo se contiene sei elementi specifici. La maggior parte dei creatori di presa in consegna non fallisce perché la richiesta è debole ma perché l'avviso manca uno, e l'host ha il diritto di ignorarlo. Questo generatore include tutti e sei:

1. A physical or electronic signature of the copyright owner or their agent
2. Identification of the copyrighted work claimed to be infringed
3. Identification of the infringing material and where it is located
4. Contact information for the complaining party
5. A statement of good-faith belief that the use is not authorised
6. A statement, under penalty of perjury, that the information is accurate and you are authorised to act

Quando il sito ti ignora

La maggior parte dei creatori invia una email, non sente niente, e conclude che il processo non funziona. Di solito fa Hoppenstedt ha solo più di un passo, e quasi nessuno viene detto cosa sono.

1. Send to the host. The site's designated DMCA agent. Most legitimate hosts act within 1–14 days because ignoring a valid notice costs them their safe-harbour protection.
2. Go upstream to the actual hosting provider. If the site ignores you, find who hosts it and send the same notice there. Hosts have far more to lose than the site does and will often pull the whole account.
3. Go to the CDN or proxy. Many of these sites sit behind a proxy. The proxy will usually not remove content, but will forward your notice and disclose the real host, which is what you need.
4. De-index with the search engines. Google and Bing both accept DMCA notices. This does not remove the content but it removes the traffic — which is most of the damage, since almost nobody types these URLs directly.
5. Report to the payment processor. If the infringing site takes payments, its processor has policies against infringing merchants and moves faster than any host.
6. Go to the registrar. Last resort, slowest, occasionally decisive when the whole site is dedicated to infringement.

Il passo più gente salta

De-indicizzazione. Google e Bing entrambi accettano avvisi DMCA, e la rimozione di una pagina dalla ricerca rimuove la maggior parte del danno anche se il file rimane online. Quasi nessuno digita questi URL direttamente, li trovano cercando il tuo nome. Se fai solo una cosa al di là della prima email, fai questa.

Prima di inviare

• Usa il tuo vero nome. La dichiarazione di spergiuro è ciò che dà la sua forza alla notifica. Un avviso firmato con un nome d'arte è più debole e può essere respinto.
• Il tuo nome e indirizzo possono essere passati al caricatore. Gli host spesso inoltrano l'avviso ricevuto. Se questo è un problema di sicurezza, un servizio di presa in carico o un avvocato può presentare per vostro conto come il vostro agente...
• Solo il lavoro che possiedi. Un avviso consapevolmente falso comporta una vera responsabilità.
• Tieni i registri. Date, destinatari e risposte contano se si intensifica.

Se si desidera monitorare perdite e prelievi nel tempo, che è all'interno dell'applicazione, e anche lì archiviamo solo URL, mai il vostro lavoro.
